Terms of Service

Plain English up top. Be a decent person. Don't post stuff that hurts others or breaks laws. We can remove content, suspend, or terminate accounts that do. We provide the app "as is." If you have a problem, email us at <PRIVACY_CONTACT> first.

These Terms of Service (the "Terms") form a binding agreement between you ("you" or "User") and <COMPANY_NAME> covering your use of the Dillydally mobile application, the website at <MARKETING_URL>, and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, do not use the Service.

1. Eligibility

  • You must be at least 13 years old to use the Service.
  • If you are between 13 and the age of digital consent in your country, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
  • You must not be barred from using the Service under the laws of your country or any country where you use the Service.

2. Your account

  • You may sign in only with Sign in with Apple or Sign in with Google.
  • You are responsible for keeping your sign-in credentials at Apple or Google secure. We are not responsible for losses caused by unauthorized access to your Apple ID or Google account.
  • You may have only one account per person.
  • You may not impersonate another person or organization in your handle, your videos, or any other content.

3. License to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service for non-commercial personal purposes, subject to these Terms. We may suspend or revoke this license at any time as described in Section 9.

4. User content and license to us

"User Content" means anything you submit to the Service: videos you record, captions, notes on completions, your handle, your reports of other content, and similar.

4.1 You own your content

You retain ownership of your User Content. We do not claim copyright in it.

4.2 License you grant us

To run the Service, you grant <COMPANY_NAME> a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, transcode, adapt, modify (only as necessary for storage and delivery — e.g., generating thumbnails or different bitrate variants), reproduce, publicly display, and publicly perform your User Content, in connection with operating, providing, and improving the Service. This license is the minimum we need to host your video at our processor (Mux), serve it to other users in their feed, and transcode it for different devices. The license ends when you delete the content, when your account is deleted, or when we remove it under our Moderation Policy — except to the extent it is reasonably required for backups, compliance with law, or pre-existing aggregate analytics.

4.3 License you grant other users

When you publish a video to the feed, other users get the right to view that video and react to it within the Service. They do not get a license to download, repost, or distribute it outside the Service. Their use of your content is bound by these Terms too.

4.4 Your representations about your content

For each piece of User Content you submit, you represent and warrant that:

  • You created it, or you have all rights necessary to share it on the Service.
  • It does not infringe any copyright, trademark, right of publicity, privacy right, or other right of any third party.
  • It does not violate the Acceptable Use rules in Section 5.
  • It does not contain any sensitive personal data (e.g., government IDs, medical records, financial account numbers).

5. Acceptable Use

You agree not to use the Service to:

  • Harass, threaten, or bully any person, including via captions, reports, or videos.
  • Post content that is hateful or discriminatory based on race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, serious disease, disability, or veteran status.
  • Post sexual content, nudity, or content sexualizing minors. Posting or distributing child sexual abuse material is a permanent ban with no appeal and a referral to law enforcement.
  • Post content depicting graphic violence, gore, or self-harm, or content that promotes self-harm or suicide.
  • Post content that promotes or facilitates illegal activity, including but not limited to violence, drug trafficking, weapons sales, fraud, or invasions of privacy.
  • Post misleading or deceptive content, including impersonation, deepfakes, or coordinated inauthentic behavior.
  • Post spam, repetitive content, or content whose primary purpose is driving traffic to another platform or product.
  • Use the Service to collect data about other users by automated means, scrape feeds, or reverse-engineer the API.
  • Attempt to circumvent the daily cap, the commit interstitial, or rate limits through technical means. The cap is the product.
  • Upload someone else's video as your own.
  • Submit false reports to abuse the moderation queue.

6. Moderation and reporting

We moderate User Content under the policy at <MARKETING_URL>/dillydally/moderation. Highlights for these Terms:

  • Every video uploaded is held in a "pending" state and scanned automatically for prohibited content. Only "approved" videos appear in any user's feed.
  • We may remove, restrict, or refuse to display any User Content we believe violates these Terms or our Moderation Policy, or that we are required to remove by law.
  • You can report any video from inside the App. We aim to review reports within 24 hours.
  • Decisions can be appealed by emailing <PRIVACY_CONTACT>.

7. Service rules and limits

  • Daily cap. The feed ends at 10 cards per day. Don't try to bypass this.
  • Upload gate. You must complete at least 3 prompts before you can upload your first video. This is in the product to filter drive-by spam.
  • Upload rate limit. A maximum of 5 video uploads per user per day.
  • Video length. A maximum of 30 seconds per video.

We may change these limits over time. We'll surface meaningful changes in-app.

9. Suspension and termination

  • We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, our Moderation Policy, or applicable law, or if your account is involved in conduct that risks harm to other users or the Service.
  • We will, where practical, give you notice and a chance to cure. Severe violations (e.g., CSAM, threats of violence) result in immediate termination with no notice.
  • You can delete your account at any time in Settings → Delete Account. See the Privacy Policy for what gets deleted and what (in anonymized form) is retained.
  • Sections 4.2, 5, 10, 11, 12, 13, and 14 survive any termination.

10. Third-party services

The Service relies on third-party processors, including but not limited to Apple Sign In, Google Sign In, Supabase, Mux, PostHog, Sentry, and OpenWeather. Their respective terms apply to your use of those services through us. We are not responsible for their conduct, but we will only use processors that meet the standards in our Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Service will be accurate or reliable.
  • Any errors in the Service will be corrected.

The Service includes user-generated video content. We moderate, but we do not pre-screen every frame. You may encounter content you find objectionable. Use the in-app report flow.

The Service is not a substitute for professional advice. If you are struggling with mental health, see the resource link in the report flow or contact 988 (US) / your local crisis line.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL <COMPANY_NAME>, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00) OR THE AMOUNT YOU PAID US IN THE SIX MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. The Service is free during MVP, so for most users the cap is US $100.

Some jurisdictions do not allow exclusion of certain warranties or limitation of certain damages. In those jurisdictions, the limitations above apply only to the extent permitted.

13. Indemnity

You agree to indemnify, defend, and hold harmless <COMPANY_NAME> from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your User Content, your violation of these Terms, or your violation of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of <GOVERNING_LAW>, without regard to its conflict-of-laws rules. You and <COMPANY_NAME> submit to the exclusive jurisdiction of the state and federal courts located in <DISPUTE_VENUE> for any dispute arising out of or related to these Terms or the Service.

If you are an EU/UK consumer, the mandatory consumer-protection laws of your country of residence apply notwithstanding the choice of law above, and you may bring claims in the courts of your country of residence.

15. Changes to these Terms

We may update these Terms. If we make material changes, we will:

  • Update the version number and <EFFECTIVE_DATE> at the top.
  • Surface a notice in-app on next sign-in.
  • For changes that materially reduce your rights, give at least 30 days' notice before the change takes effect.

Your continued use of the Service after changes take effect means you accept the new Terms. If you don't accept them, delete your account in Settings.

16. Miscellaneous

  • Entire agreement. These Terms, the Privacy Policy, and the Moderation Policy together form the entire agreement between you and us about the Service.
  • Severability. If any provision is unenforceable, the rest stays in effect.
  • Waiver. Our failure to enforce any provision is not a waiver.
  • Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • No third-party beneficiaries. Apple is a third-party beneficiary of these Terms with respect to your use of the App on iOS, with the right to enforce them against you.
